§ 3-33. Powers and duties.

  • The alcohol control commission is hereby vested with the following duties and powers:

    (1)

    Initial applications. To screen, verify, investigate and review all initial applications for licenses for the sale of liquor, wine and malt beverages, at wholesale and retail, by the package and by the drink.

    a.

    To grant or deny licenses to sell malt beverages by the package at wholesale or retail, wine by the package at wholesale or retail, liquor by the package, and for the sale of liquor, wine and malt beverages, at wholesale and retail, and by the drink.

    (2)

    Renewals. To investigate and hear reports and charges constituting probable cause not to renew licenses for the sale of liquor, wine and/or malt beverages, at wholesale and retail, by the package and by the drink.

    a.

    To make recommendations to the city commission to grant or to deny renewals of licenses for the sale of liquor by the package and for the sale of liquor, wine and/or malt beverages by the drink.

    b.

    To grant or deny renewals of licenses to sell malt beverages and/or wine by the package at wholesale or retail.

    (3)

    Suspension, revocation; probation; monetary sanction. To investigate and hear reports and charges constituting probable cause to suspend or revoke licenses for the sale of liquor, wine and/or malt beverages, at wholesale and retail, by the package and by the drink, or to impose monetary sanctions and to recommend to the city commission whether and what such penalty should be imposed.

    (4)

    Appeals. To hear appeals on the seizure of a license by the chief of police, the assistant chief of police, a duly authorized officer or the license inspector under sections 3-81, 3-183, 3-240, and 3-306, and to affirm, reverse, modify or make recommendations to the city commission upon the actions of the suspending officer.

    (5)

    Entertainment. To receive reports on, to investigate and to approve and disapprove, entertainment at pouring outlets, all as provided in section 3-278, and to take or recommend such action as is appropriate in the case of such disapproval.

    (6)

    Employees. To receive reports on, to investigate and to approve or disapprove employees of retail outlets for the sale of alcoholic beverages by the package or by the drink, all as provided in section 3-34, and to take such action as is appropriate in the case of such disapproval.

    (7)

    Ordinances and policies. To recommend to the city commission modifications to the ordinances and policies of the city pertaining to the regulation, control and taxing of liquor, wine and malt beverages.

    (8)

    Complaints, etc. To hear complaints, suggestions and recommendations from the city manager, the city commission, police department, state officials, alcoholic beverage dealers and the public at large as to the operation of liquor, wine and malt beverage outlets within the city.

    (9)

    Rules and regulations. To promulgate rules and regulations governing procedures before it.

    (10)

    Consumption of alcoholic beverages on public property. To grant or deny temporary permits to allow the consumption of alcoholic beverages on public property not otherwise exempted under code section 14-3(3), to place conditions on such temporary consumption permits, and to promulgate guidelines for the application, approval and use of such temporary consumption permits.
